General Terms & Conditions of www.cg.fashion – valid as of May 2018.
§1 SCOPE OF VALIDITY
The following terms & conditions apply for all orders placed via our online shop.
§2 CONTRACTUAL PARTNER, CUSTOMER SERVICE
The purchase contract shall become effective with Création Gross GmbH & Co KG. You can find further information about us in the Legal Notice. You can contact our customer service for questions, complaints and objections, Mon-Fri 9:30-18:00, on +49 (0) 89 143 67 152 277.
§3 CONCLUSION OF CONTRACT
- The depiction of the products in the online shop does not represent a legally binding offer, but rather a non-binding online-catalogue.
- You can place our products into the basket, without obligation to begin with, and correct your entries at any time using the correction aids provided and explained during the order process, before sending your binding order.
- By clicking on the „BUY NOW" order button, you place a binding order for the goods contained in your shopping cart.
- Confirmation of the receipt of the order, together with the acceptance of the order, shall be issued immediately following order dispatch, by means of an automated email. The purchase contract shall become effective with this email confirmation.
- A binding contract may also have already come into effect as follows:
- If you have selected credit card payment, the contract shall come into force at the time the credit card is charged.
- If you have selected PayPal as the means of payment, the contract shall come into force at the time of your confirmation of the payment transfer with PayPal.
- A condition for an effective conclusion of contract is always that the order process is completed with the dispatch of the order.
§4 DISPATCH COSTS
In addition to the stated product prices, delivery costs will be charged. More concerning the amount of delivery costs can be found in the offers.
We only deliver by mail order. Collection of goods in person is, unfortunately, not possible.
All prices stated on the seller’s webpages are inclusive of the applicable statutory VAT. Within Germany, deliveries over the value of € 50 are sent free of charge, and for orders below this value we charge a € 4.95 shipping fee. For deliveries to France, the Netherlands, Belgium, Luxembourg and Austria, orders over the value of € 200 are sent free of charge, and for orders below this value we charge a € 6.95 shipping fee. For deliveries to Great Britain, orders over the value of ₤ 150 are sent free of charge, and for orders below this value we charge a ₤ 5.75 shipping fee.
§5 PAYMENT METHODS
The following means of payment are available in our shop:
When selecting prepayment as a means of payment, we provide our bank details in the order confirmation and deliver the goods following receipt of payment.
When submitting your order, you transmit to us your credit card details at the same time. Once you have been confirmed as the lawful cardholder, immediately upon completion of the contract, we contact your credit card issuer to initiate the payment transaction. The payment transaction is carried out automatically by the credit card company and your card charged.
You pay the invoice amount via the online provider Paypal. During the order process, you will be directed onto the website of online provider PayPal. You must be registered with the service or first register, legitimise with your access data and confirm the transfer of the payment to us (if applicable, guest access is an exception). You will receive further information during the order procedure.
If we offer advance payment, e.g. when purchasing on account, if necessary, in order to safeguard our legitimate interests, we gather credit information based on statistical procedures from Creditreform, Hellersbergstraße 12, 41460 Neuss. To this end, we transfer the personal information required for a credit check to Creditreform and use the acquired information regarding the statistic probability of non-payment to make a balanced decision regarding the payment options to be granted. The credit information may include probability values (scores), which are calculated on the basis of scientifically recognised statistical procedures that, among other data, incorporate address data into the calculation. Your legitimate interests will be taken into consideration in accordance with the legal provisions. You can object to this check at any time with future effect. This may have the result that we can no longer offer you the specified payment options. If necessary, data belonging to CG – CLUB of GENTS Online Shop will be used as an aid.

The payment methods that will be offered to the customer in the specific case depend on this credit check. In the case of payment on invoice, the amount is to be settled within 10 days following receipt of invoice without reductions.
With Amazon Payments you use the payment and shipping information that you have stored in your Amazon account to make payment. In addition, during the order process, you will be directed onto the website of online provider Amazon, before completion of the ordering procedure in our online shop. All you require are you Amazon login details. You must be registered with the service or first register, legitimise with your access data and confirm the transfer of the payment to us. Further information regarding how to access the payment provider’s website are provided during the ordering process.
We only deliver to locations on the dispatch route Unfortunately the self-collection of goods is not possible.
§7 DELIVERY TIME
Delivery within Germany: We deliver within 2 – 3 working days. Delivery time for Austria: 2 – 4 working days. Delivery time for Belgium, Luxembourg, the Netherlands, France and the UK: 3 – 5 working days.
§8 RETENTION OF OWNERSHIP
The goods shall remain our property until complete payment has been made. If we do not have a depicted item in stock, we reserve the right to withdraw. No claims for compensation for damages or other claims can be asserted.
The consumer has entitlement to a guarantee for defects in the purchased goods, in accordance with the statutory provisions of §§ 437 ff. BGB. In particular, the customer can request supplementary performance (re-delivery or correction of faults). CG – CLUB of GENTS Online Shop is, however, entitled to refer the customer to a new delivery, if the correction of the defect involves disproportionate expenditure. Guarantee claims shall be forfeited unless made within two years of the delivery of the goods. The purchaser should assert his guarantee claims stating the order number, his name and address and a brief statement of the reasons for the claim. The customer shall, at the request of CG – CLUB of GENTS Online Shop , send the faulty goods for inspection, at the expense and risk of CG – CLUB of GENTS Online Shop , to the following address:

§10 DELIVERY TO NON-EU COUNTRIES
At present deliveries are possible wihin Germany and to Great Britain, France, the Netherlands, Belgium, Luxembourg and to Austria.
§11 TRANSPORT DAMAGE
If goods are delivered with clear transport damage, then report such faults to the delivery agent as soon as possible and please contact us immediately. Failure to issue a complaint or make contact is of no consequence to your legal claims and their assertion, in particular your guarantee rights. They will, however, facilitate us in asserting our own claims against the carrier or our transport insurance.

§14 DATA PROTECTION
The customer’s personal data that is made known to CG – CLUB of GENTS Online Shop within the scope of the business relationship will be stored and, if necessary, forwarded to associate companies for the processing of the order. All data will of course be treated confidentially. The data will be collected, stored and used in accordance with the applicable data protection provisions. These data protection provisions can be called up in printable format (see Data Protection Declaration).
§15 RETURN OF GOODS / REVOCATION
CG – CLUB of GENTS Online Shop also accepts the return of the goods to the address below as a means of revocation.
§16 REVOCATION PERIOD
In deviation from the statutory period of 14 days, Création Gross GmbH & Co KG grants revocation within 30 days.
§17 REVOCATION INSTRUCTION
You will then receive instruction regarding the prerequisites and consequences of the statutory right of revocation in the case of shipping orders.
You have the right to withdraw from this contract within fourteen days, without stating a reason. The revocation period is fourteen days from the day on which you or a third party appointed by you, who is not the carrier, accepted the final partial delivery or the last item into your possession. In order to exercise your right of revocation, you must inform us (CG – CLUB of GENTS Online Shop, c/o Création Gross GmbH & Co KG , Houbirgstr. 7, 91217 Hersbruck, email@example.com, +49 (0) 89 143 67 152 600) by means of a clear statement (e.g. by means of a letter sent by post, fax or email) of your decision to withdraw from this contract. To do so, you can use the template revocation form provided, however, this is not essential. In order to adhere to the revocation period it is sufficient that you send the notification regarding the exercising of the right of revocation prior to the expiry of the revocation period.

CONSEQUENCES OF REVOCATION
If you withdraw from this contract, we must refund to you all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from a decision on your part to opt for a type of delivery other than the cheapest standard delivery that we offer), immediately and within fourteen days from the day on which we receive notification of your revocation from this contract. For this refund we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged fees on account of this refund. We are entitled to delay the refund until we have received the goods back or until you have provided proof that you have sent the goods back, depending on which occurs first. You must return or hand over the goods to us or to CG – CLUB of GENTS Online Shop, c/o Création Gross GmbH & Co KG , Houbirgstr. 7, 91217 Hersbruck, without delay and in any case within fourteen days from the day on which you notify us of your revocation from this contract. The deadline shall be deemed to have been met if you submit the goods prior to the expiry of the fourteen-day period. We cover the costs of the return of goods. You are only required to pay for any depreciation in the value of the goods, if this depreciation occurs as the result of handling on your part that does not fall within the scope necessary for verifying the condition, features and function of the goods.

The depiction of the item can differ in specific details or entirely from the supplied goods. We always attempt to depict the item as accurately and precisely as possible, however, colour deviations can occur as a result of different screen settings.
§19 FINAL PROVISION
The law of the Federal Republic of Germany applies to all contracts between CG – CLUB of GENTS Online Shop and the customer, the exclusion of the UN Convention on Contracts for the International Sale of Goods. This choice of law only applies insofar as the consumer protection laws of the state in which the consumer has his permanent place of residence at the time of placing his order that are thus rendered non-mandatory are withdrawn.
§20 CONTRACT LANGUAGE
The language permitted for the conclusion of the contract is German.

§22 ONLINE DISPUTE REGULATION PLATFORM
The European Commission provides an Internet platform for online settlement of disputes (so-called. „ODR platform") ready. The ODR platform should serve as a focal point for the extrajudicial settlement of disputes arising from online sales contracts. The OS platform can be contacted at the following link from 15.02.16: http://ec.europa.eu/consumers/odr. According to certain regulations, the seller is not obliged to participate in the dispute resolution procedure of this consumer arbitration body, however has agreed to do so voluntarily.
